TRAINING ON CONSTITUTIONAL PROCEEDINGS LAUNCHED AT OUR UNIVERSITY

At our educational institution, a training session entitled “Supremacy of the Constitution and the Development of the Amicus Curiae Legal Institution in Constitutional Proceedings” has commenced, organized by the Faculty of Law.

The event has brought together advocates, legal consultants, members of the academic staff of higher educational institutions, representatives of the Commissioner for Human Rights, representatives of the Commissioners for Children’s Rights and Family Affairs, as well as civil society organizations.

The moderator of the training is Aliya Berdibayeva — an analyst of the Constitutional Court of the Republic of Kazakhstan, Candidate of Legal Sciences, and Associate Professor. She noted:

“The purpose of today’s training is to raise awareness among representatives of the legal community regarding the forms of participation in constitutional proceedings as experts and to strengthen their understanding of their rights and responsibilities. We also aim to discuss problematic issues arising during the Constitutional Court’s consideration of citizens’ appeals, identify their causes, and propose possible solutions and approaches. In addition, the training focuses on analyzing issues emerging between international and national legal norms.”

Opening the event, Rector Zhanar Temirbekova stated:

“Today, another important event has begun at our university. We do not regard this training merely as a professional meeting. I believe this gathering serves as an important platform for dialogue aimed at developing constitutional justice in our country, strengthening the rule of law, and protecting the fundamental rights and freedoms of citizens.”

She also provided detailed information on the potential of the Constitutional Court and the reforms and initiatives currently being implemented in the country’s legal sphere.

Subsequently, Judge of the Constitutional Court Aigul Kydyrbayeva and Vera Zakutnyaya, Executive Director of the “Sana Sezim” Women’s Initiatives Legal Center Public Association, shared their views and opinions.

The opening ceremony continued with special panel sessions on the following topics:

- “Supremacy of the Constitution as the Foundation of a Rule-of-Law State” 

- “Accessibility of Appeals to the Constitutional Court of the Republic of Kazakhstan and the Current State of Constitutional Oversight Bodies” 

- “Constitutional and Legal Aspects of the Interaction between Domestic and International Law” 

- “The Amicus Curiae Legal Institution in Constitutional Proceedings” 

Among the session speakers are Aliya Berdibayeva, Judge of the Constitutional Court Aigul Kydyrbayeva, and Doctor of Law, Professor of L.N. Gumilyov Eurasian National University, Yermek Abdrassulov.

During the sessions held within the framework of the training, participants will comprehensively discuss the fundamental principles of constitutional supremacy and the rule of law, the functions and powers of the Constitutional Court, and the mechanisms through which citizens may apply to constitutional oversight bodies.

In addition, attention will be given to the relationship between international and national legal norms, the specific features of their application within national legislation, and methods of resolving legal conflicts. The sessions will also emphasize the role of constitutional oversight bodies in strengthening legality and protecting human rights and freedoms. Furthermore, extensive discussions will focus on the significance of the Amicus Curiae (“friend of the court”) institution in constitutional proceedings, the role of independent expert opinions, and international practices in this area.

It should be noted that the training program will continue until May 21.
